Terms of Service

These Terms of Service (“Terms”) govern your use of this website, operated by Atlas Workwear (“Atlas,” “we,” “us”). By using the site or submitting a form on it, you agree to these Terms. If you don’t agree, please don’t use the site.

A pre-launch website

Atlas is in development. This site shares information about products and programs we are building. Nothing on it is an offer to sell, and no products can be purchased through it. Designs, features, materials, specifications and timelines, including our expected launch date, may change without notice.

Product information and standards

References to NFPA 1970 describe the standard our products are being engineered to. They do not state that any product has been tested, listed or labeled by a third party. When products become available, their labels and accompanying documentation will describe their performance and will take precedence over anything on this site. Sketches and illustrations are working drawings, not final products.

Updates and the founding agency program

Signing up for updates or applying to be a founding agency does not create any obligation for you or for us. We choose founding agencies at our discretion. Any participation, fitting, supply or other arrangement will be governed only by a separate written agreement signed by both parties.

Using the site

You agree not to:

• submit false information or information about someone else without their permission;
• use bots, scrapers or other automated means to access the site or submit forms;
• interfere with or disrupt the site, or attempt to gain unauthorized access to any part of it;
• use the site for any unlawful purpose or in violation of these Terms.

Intellectual property

The site and its content, including text, graphics, sketches, the Atlas name and the load line mark, belong to Atlas Workwear or its licensors and are protected by intellectual property laws. You may view the site for your own personal or internal agency use. You may not copy, modify, distribute or create derivative works from its content without our written permission.

Feedback

If you send us ideas, suggestions or feedback about our products or programs, you give us permission to use them without restriction or compensation to you. Please don’t send confidential information.

Privacy

Our Privacy Policy explains how we handle information you submit through the site.

Disclaimers

The site is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the site will be uninterrupted, error-free or free of harmful components.

Limitation of liability

To the fullest extent permitted by law, Atlas Workwear will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising out of or related to your use of the site. Our total liability for any claim related to the site will not exceed one hundred U.S. dollars (US$100). Some jurisdictions do not allow these limitations, so they may not apply to you.

Indemnity

You agree to indemnify and hold harmless Atlas Workwear from claims arising out of your misuse of the site or your violation of these Terms.

Governing law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located there, and you consent to their jurisdiction.

Changes and termination

We may update these Terms by posting a new version on this page and changing the effective date above. Continued use of the site after a change means you accept the updated Terms. We may suspend or discontinue the site, or your access to it, at any time.

General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms are the entire agreement between you and us about the site.
